- Refuse: The two trees are an important feature to the road and surrounding area contributing to its verdant and arboreal character. For this reason, it is felt that both trees are of public high amenity and contribute the setting of the area. The proposed removal of the smaller oak tree will leave the remaining tree exposed to high winds and break the distribution of uniform stress the two trees have collectively in prevent damage to the crowns of the trees in storm situations. In doing so it is felt the remaining tree will become a greater risk to safety than the two trees present at the time of the site visit. For this reason, the council cannot justify giving consent to the removal of the smaller of the two oaks at this time. Allowance of lesser works: From the site visit it was seen that the issues and concerns the occupants of the property have could be addressed through lesser means and the council would consider them acceptable. These are as follows. To reduce the crown of both oak trees away from the house to achieve a 1.5 metre clearance from the gutter line. The crowns of the smaller oak could be raised to the gutter line of the house and the crown of the larger oak tree can be raised to the gutter line on the side of the canopy facing the property and the lowest limb extending over the road can also be removed. The remaining crown should then be lightly trimmed to leave the tree with a natural looking form.
