Certificate of Lawfulness for the existing: seeking confirmation that the previously submitted and approved Planning & Conservation Area Application (Ref - 08/20/00157/AGE) dated 16th November 2023 is deemed to be implemented based on the construction works completed so far. The photos submitted show the approved works proposed having commenced by way of removal of the existing balcony structure, including the pedestrian doorset serving the dining room area at 1st floor level. Furthermore, the photos show the lower section of the opening has now been infilled with masonry cavity wall construction and a new window module has been installed above. In addition, works to construct the new mono-pitched roof structure proposed over the former balcony area have commenced and will be completed within the next month or so i.e., before the winter sets in and works to the vertical extension and rear balcony structure proposed will commence during the Spring of 2024. The proposal description of the previously approved Planning & Conservation Area Application (Ref - 08/20/00157/AGE) dated 16th November 2023 makes express / explicit reference to 'removal of existing front balcony' and 'alterations to the existing front balcony door to a window'. With this in mind, it is therefore assumed the works completed so far constitutes material development, especially as the completed works directly impact on / form part of the principal roadside / front elevation of the subject property. It is therefore believed the previously approved Planning & Conservation Area Application (Ref - 08/20/00157/AGE) dated 16th November 2023 has successfully been implemented and is therefore deemed to be extant and will therefore continue to be 'alive' beyond the 16th November 2023 expiry set out the Approval Certificate - copy of which has been submitted for ease.
