The tree related to in this application is located in the rear garden of 6, Woodlands Close. 1 x Horse Chestnut (T24 of the Order) - reduce by 3m overall. Its current height is 27m tall. The spread is over 10m. It overhangs both neighbouring gardens, and the garden to the rear, in Carey Down. The tree has an impact in that no other vegetation is capable of growing in its shade, including grass. It is having an effect on the neighbouring tree by dominating it to the point of restricted growth. There is a serious loss of light, the tree is over sized for its location, looking like die back has been present and causing damage to gutters with leaf drop and birds messing. From a safety point of view, the tree is lopsided and overgrown. In an open environment it could carry on as no risk is posed. However, At least two houses are seriously affected by any issue with the branches becoming too weighted, or the tree continuing to grow in an unstable manner. The risk to at least two immediate properties, and possibly another two is now substantial. If the tree itself fell it would destroy one or more of the mentioned homes, causing possible death or injury. The fall of a weak bough or limb would be equally as concerning as the damage caused would also be a danger to property or human health. Following an application in 2016 planning rejected a request to have this potential hazard lobbed, professionally. We re-apply due to the seriousness of the overgrown hazard. We trust you will seriously consider this application. Any liability for the consequences of harm to health, property or life must now fall to the council department who fail to see this risk. Indeed, insurance companies have confirmed that any claim for such a situation would result in a full investigation as to what steps were taken to prevent loss or injury, and as such, pursue damages accordingly.
